Position Summary
This Counsel II position within MassDOT’s Office of the General Counsel is assigned to the MassDOT Registry of Motor Vehicles Division (“RMV”). The Counsel II reports to the RMV’s Deputy Chief Counsel and works with the attorneys assigned to the RMV to provide superior legal services to the RMV staff and business units. The Counsel II’s primary responsibility will be representing the RMV in hearings before the Division of Insurance’s Board of Appeals (“BOA”) on matters related to suspensions and revocations of commercial and noncommercial driver’s licenses or the right to operate a motor vehicle in Massachusetts. The Counsel II will also directly support the RMV’s Driver Control Unit (“DCU”) by serving as a legal advisor to DCU hearing officers.
Duties and Responsibilities
- Represent the RMV in administrative appeal hearings before the BOA on matters related to M.G.L. c. 90, c. 90D, and c. 90F.
- Provide advice and counsel in the areas of motor vehicle licensing and suspensions (including both noncommercial driving privileges and Commercial Driver’s License (CDL) matters).
- Provide legal support to DCU hearing officers, the Interlock department, the Medical Affairs Unit, the Out-of-State Unit, and other business units as assigned.
- Develop and maintain a thorough and current knowledge of applicable Federal and state laws, including statutes, regulations, and case law related to license suspension, including but not limited to, OUI suspensions, chemical test refusals, interlock ignition device requirements and commercial driver license eligibility requirements.
- Interpret court decisions and opinions, statutes, rules, and regulations applicable to the RMV.
- Collaborate as part of the MassDOT legal team assigned to the RMV to make legal determinations, issue written guidance and conduct legal trainings for the RMV.
- Liaison with external partners to provide information and education on the RMV’s role relative to M.G.L. c. 90, c. 90F, and driver license suspensions and revocations.
- Liaison with the Attorney General’s Office for pending 30A litigation.
- Serve as a Special Assistant Attorney General, representing the RMV in court, when necessary.
- Other related duties as assigned.
Requirements
- Juris Doctorate Degree is required.
- Member in good standing of the Massachusetts Bar with annual certification and registration by the Board of Bar Overseers.
- Minimum 5 years’ experience as a practicing attorney.
Preferred Skills/Experience
- Interest in public service and government.
- Litigation experience in criminal matters or civil/administrative proceedings preferred.
- Experience with OUI/license suspension matters.
- Experience reviewing statutory authority and providing written legal guidance.
- Ability to manage and prioritize high-volume caseload.
- Ability to respond to multiple stakeholders in a fast-paced work environment.
- Excellent communication and organization skills.
- Proven problem-solving skills and sound judgment.
Minimum Entrance Requirements
Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and at least three years of full-time, or equivalent part-time, professional experience in the practice of law.
Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
