The General Counsel's Office at the Executive Office of Health and Human Services is seeking a collaborative Attorney to provide legal support for MassHealth and other EOHHS programs. The Attorney will perform a wide range of complex legal activities associated with the development, implementation, and administration of EOHHS and MassHealth programs and healthcare initiatives.
The Executive Office of Health and Human Services (EOHHS) is the Commonwealth’s largest secretariat and responsible for developing, coordinating, and managing the Commonwealth’s health, welfare, and human services operations and programs. EOHHS administers the Commonwealth’s Medicaid program, known as MassHealth. MassHealth is a cooperative state and federal program that provides health care benefits and premium assistance for uninsured families, disabled individuals, children, long-term unemployed adults, and seniors. The mission of MassHealth is to improve the health outcomes of our diverse members, their families, and their communities, by providing access to integrated healthcare services that sustainably promote health, well-being, independence, and quality of life. MassHealth benefits include hospitals, physicians, nursing facilities, prescription drugs, and other health and long-term care services. MassHealth’s delivery systems currently include a variety of managed care options as well as an extensive network of fees for service providers who contract directly with MassHealth.
The General Counsel's Office functions as EOHHS’ in-house counsel. The Attorney will perform a wide range of complex legal activities associated with the development, implementation, and administration of EOHHS programs and initiatives involving both MassHealth providers and members. Duties and Responsibilities (these duties are a general summary and not all-inclusive):
- Represent, and assist the Attorney General's office in representing, the agency in both affirmative and defensive litigation.
- Offer advice and risk analysis concerning the applicability of and compliance with all federal and state statutes and regulations that may affect EOHHS’ ongoing activities and new initiatives, whether involving program or policy matters, operational issues, or spending activities.
- Provide legal opinions and advice to EOHHS and EOHHS agency program managers and staff on various matters.
- Maintain a thorough knowledge of state and federal laws related to EOHHS constituent agencies, state finance and appropriations, and public procurements.
- Provide legal assistance in responding to requests for public records, subpoenas, and other record requests.
- Identify and evaluate potential legal exposures, developing legally defensible alternative courses of action, and assisting clients in formulating creative problem resolutions and strategies.
- Analyze the impact and applications of existing, proposed, and developing laws on EOHHS and EOHHS agency programs.
- Identify the need for, and assisting in the drafting of, new legislation and regulations.
- Review and draft legal documents, including both regulatory and sub-regulatory interpretive material, and correspondence.
- Review and draft requests for proposals, contracts, interagency service agreements, and related procurement documents.
Required Qualifications:
- A minimum of one year of full-time, or equivalent part-time, professional experience in the practice of law or a position requiring membership in the Bar.
- Excellent academic background and demonstrated skills and significant experience in counseling clients, legal research and analysis, oral and written advocacy, and creative problem-solving.
- Exceptional interpersonal skills and the desire to work in a collaborative legal office.
- Background in and understanding of the state and federal government, health and administrative law, health care issues, and public policy.
- Prior litigation experience or comparable to, in-house or outside counsel to public agencies, private businesses, or other organizations.
Preferred Qualifications:
- Ability to effectively manage multiple projects simultaneously for a varied group of clients.
- Desires to work in a fast-paced environment.
- Strong interest or prior experience in learning about state and federal government options, health and administrative law, health care issues, and public policy.

MINIMUM ENTRANCE REQUIREMENTS:
Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and some experience in legal research, legal writing, and legal procedures and processes.
Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
