General Overview
Mass General Brigham’s Office of the General Counsel (“OGC”) is seeking to hire an attorney with six to eight years of experience to assist with internal and external investigations and a wide array of compliance matters in the areas of data privacy, fraud and abuse, Medicare and Medicaid billing, research compliance, and general regulatory concerns. Strong academic credentials and excellent writing and interpersonal skills are required. Relevant experience in the office of a U.S. Attorney or state Attorney General and/or relevant experience in a law firm or in-house legal department representing large organizations is required. The lawyer in this position will be part of a team that provides legal support for litigation, compliance, contracts, data privacy, and cyber security to Mass General Brigham and its affiliated hospitals and other provider and payer organizations, and will report to the Section Head of OGC’s Litigation, Compliance and Contracts Section. The OGC team is highly collaborative, collegial, and dedicated to providing the strategic legal advice and guidance necessary to fulfill the system’s four-part clinical, research, academic, and community mission. Job Responsibilities
- Assist with all aspects of government- and/or internally-initiated investigations, including all necessary fact-finding responsibilities (document collection, witness interviews, claims analysis, etc.), legal analysis, risk assessments, negotiations, and internal and external communications on a variety of fraud and abuse concerns;
- Manage a broad range of regulatory and compliance matters, including issues related to the Anti-Kickback Statute, Stark Law and/or False Claims Act, Medicare and Medicaid reimbursement, data privacy, drug diversion, licensing, research compliance, telehealth, and general compliance and risk management;
- Handle various pre- and post-litigation matters, including contract disputes, intellectual property issues, construction and building-related questions, and insurance coverage issues;
- Partner with and provide legal advice and support to diverse groups of clients across the MGB system, with a focus on assisting Chief and Billing Compliance Officers at both the system- and entity-level and presenting to and strategizing with leadership to address compliance issues and mitigate and manage risks;
- Engage, partner with and cost-effectively manage outside counsel representing MGB and/or its affiliates;
- Interpret laws, rulings, and regulations for the organization and stay up to date with current developments in areas of responsibility and communicate changes in the law to clients, as applicable;
- Perform other responsibilities as assigned by the Section Head.
Qualifications
- JD from an accredited law school, licensed and in good standing before the Massachusetts bar;
- A minimum of six to eight years of relevant experience handling litigation, fraud and abuse, and/or compliance and regulatory matters, with a preference for experience as an attorney in the office of a U.S. Attorney or state Attorney General. Additional relevant experience in a law firm or in-house legal department representing large organizations in the health care, life sciences, or biotech industries is preferred;
- Strong academic credentials with excellent analytical, drafting, interpersonal and communication skills;
- Ability to think strategically, problem-solve creatively, and be a savvy partner to clients to help them navigate legal risk to achieve business objectives;
- Possesses strong integrity, and the ability to maintain confidences while working with sensitive, confidential information;
- Ability to maintain a strong presence in client meetings and meetings with opposing counsel and parties, while representing the organization’s interests;
- Self-motivated and highly productive with the ability to work independently with strong organizational skills as well as project and time management skills;
- Strong team player with the ability to collaborate both within OGC and with cross-functional teams representing a wide range of entities and departments in a multi-cultural environment;
- Demonstrated commitment to principles of equity and inclusion.
