Position Overview
The Associate General Counsel, Labor & Employment will provide legal support on a variety of employment, benefits, and labor law activities arising throughout the life cycle of employment at Invenergy, relying on both personal expertise and experience and via the retention and management of outside counsel and/or other relevant subject matter experts. Reporting to the EVP, Legal and Chief Compliance Officer, the position will require partnership and collaboration with Business Unit and department leaders at the corporate and project level to support Invenergy’s global operations and commercial objectives.
Responsibilities
- General - Develop and implement strategies for providing accurate and timely guidance on a wide range of employment related issues, focusing on employment law, labor law, legal requirements related to diversity, equity and inclusion programs, OFCCP, Davis-Bacon Act and other compliance related to government contractor designation, employee benefits, retirement plans and (at times) personally identifiable information (PII) issues.
- Investigations and Litigation - Provide counsel regarding internal investigations, terminations and general management of employment-related claims, litigation and related matters.
- Employment Law - Keep informed of new or pending case law legislation and regulations, both domestic and international. This will include the areas of wage and hour (FLSA), leave management (FMLA), workplace accommodations (ADA, Title VII), compensation (pay transparency laws, Title VII), and other related areas.
- Benefits, I-9, and Immigration Law - Advise on legal issues involving U.S. benefit plans (ERISA and HIPAA) as well as inbound U.S. immigration and Form I-9 compliance.
- Labor Law - Advise on matters under the National Labor Relations Act (NLRA), collective bargaining, day-to-day labor relations and contract administration issues, along with managing any related disputes.
Required Qualifications
- JD degree from an accredited law school (with a strong academic record both undergraduate and graduate) and active license to practice law, in good standing.
- 7+ years of experience either within a law firm or as in-house counsel (or a combination thereof) supporting mid-sized companies with a global footprint.
- Employment Law and Labor Law experience required.
- Experience providing advice, consultation, and support for internal investigations, employment related claims, employment litigation is required.
- Demonstrated ability to manage outside counsel effectively.
- Able to work cross-functionally with internal and external stakeholders under minimal supervision.
- Excellent communication skills and ability to relay complex concepts to members of management.
- Self-starter who is proactive, can demonstrate initiative, can work independently as well as on a team, and who has a roll-up-the-sleeves mentality.
- Strong organizational and analytical skills as well as the ability to multi-task effectively in a fast-paced environment.
- Sound judgment, critical thinking, attention to detail, strong business understanding and solid negotiation skills.
- The ability to work under pressure, meet tight deadlines, and balance a heavy workload.
- An ability to analyze, interpret, and present complex legal ideas and concepts in a clear and concise fashion.
