This position, which is based in Melville, Long Island, is responsible for providing patent advice and support to a leading global prestige beauty company, including patent prosecution, opinions on validity and infringement, designing and delivering client training, negotiating, and drafting technology agreements.
Responsibilities
- Build and manage patent portfolios related to innovative skincare products, under the supervision and guidance of the Lead Patent Counsel.
- Draft and prosecute patent applications, including responding to office actions in the U.S., collaborating with patent colleagues in other regions and working with local agents in international jurisdictions.
- Support the larger R&D organization, including client counseling, invention harvesting (in concert with an IP Manager), freedom-to-operate analysis, due diligence analysis and reporting, and helping to identify non-patent legal or business risks.
- Interact with various areas of the business including commercial brand teams, clinical, regulatory, manufacturing and supply chain, and transactional groups.
- Support U.S. and non-U.S. litigation, oppositions, IPRs, or other judicial and non-judicial proceedings around the world related to the Skincare category.
- Develop and deliver training curriculum to promote IP culture and capabilities for R&D organization.
- Demonstrable aptitude for adopting technology and developing and improving processes.
- Provide other legal support as needed.
Qualifications
- Minimum of 5-7 years of experience.
- Admission in good standing to at least one State Bar and registered patent attorney with the USPTO required.
- Growth Mindset and High Ethical Standards.
- Undergraduate or graduate degree in chemistry, chemical engineering, biochemistry or similar.
- Understanding of mechanical technology sufficient to prepare and prosecute patent applications on simple packaging and components.
- Experience negotiating and drafting technology-related agreements (e.g., joint development, exclusivity, and MSAs, etc.).
- Excellent legal and business judgment; a high degree of discretion; and excellent verbal and written communication skills.
- Demonstrable aptitude for adopting and leveraging technology.
- Demonstrable experience developing and improving processes.
- Ability to effectively communicate and form strong relationships with business leaders and technical specialists.
- Ability to execute in a complex matrixed environment.
- Ability to track, balance, and execute a significant volume of tasks while managing a variety of stakeholders.
- Experience with IPfolio or other software built on the Salesforce platform preferred.
- Advanced skills with Microsoft 365 (e.g., SharePoint, Power Automate, Power BI) preferred.
- Cosmetic and/or OTC industry experience preferred.
- Global experience at AM Law 200 firm and/or multi-national Fortune 1000 company preferred.
The anticipated base salary range for this position is $120,550 to $208,200. Exact salary depends on several factors such as experience, skills, education, and budget. Salary range may vary based on geographic location. In addition to base salary, this position is eligible for participation in a highly competitive bonus program with possibility for overachievement based on performance and company results as well as participation in the share incentive plan.
